While Binks recorded a 0.113 blood alcohol reading when breathalysed by officers after crashing his vehicle at Sydney’s Milson’s Point; Justice Clifton Hoeben, presiding over the case, acknowledged road works in the vicinity were a contributing factor in the accident.
Says Hoeben: “Even though the plaintiff’s faculties were adversely affected by alcohol at the time of the accident, there is no evidence to suggest that he was not endeavouring to keep a proper lookout as best his intoxicated state would allow. He had apparently safely driven from Paddington on the night of the accident.”
Binks could have potentially received $918,000 compensation for the accident, however Justice Hoeben reduced the amount awarded by 65% to $330,253; claiming Binks was 65% responsible for the incident.
