Josh Homme sues Kyuss Lives!

Last year several Kyuss members – John Garcia, Nick Oliveri and Brant Bjork – reunited to tour under the banner Kyuss Lives! and although the band’s former guitarist Josh Homme declined to join the group he wished the others well in their efforts.

Now things have changed with Homme suing Kyuss Lives! citing “tradmark infringement and consumer fraud by Kyuss Lives!”. Bassist Scott Reeder who replaced Nick Oliveri in Kyuss after their second album and who performed a few gigs with Kyuss Lives! while Oliveri was busy dealing with the fallout from his armed standoff with police and his arrest on domestic violence charges has also joined Homme in the legal action.

Homme and Reeder have issued a statement declaring that: “It sucks. To think we went to a meeting in January solely to help them with their request to continue Kyuss Lives! With open arms, we made every attempt to help them continue Kyuss Lives! respectfully. Only to discover while they looked us in the eye, Kyuss Lives! management and band had filed federal documents in 2011 in an attempt to steal the name Kyuss. This is desperately what we were trying to avoid. It’s a sad day for us and for John – but most of all for the fans. What a needless mess.”

such shit news. their live show was amazing last year. am sure the live album will be a sweet listen though

wait, why is this happening? what changed between homme giving his blessing and now? i've read the quote a few times and i'm not sure i understand? was it a case of "you can perform, but as long as you only use the name kyuss lives! so people don't actually think it's kyuss"? and then they went and tried to use the name kyuss anyway?

i also love that the quote ends in "what a needless mess". aren't most lawsuits needless messes? how was josh losing in this deal? was it really impeding his ability to rake in more cash?

Sounds like they didn't just try to "use" the name Kyuss, but actually take legal steps to own the name and all materials created under it. This would mean a limitation on that cash raking, yes. IP rights would likely come into it under that banner and that's talking about taking away artistic ownership. It's a shame it's had to get legal, however I respect the right to fight to protect your share of something you were integral in creating.

I can understand though, both Josh and Garcia are founding members and they would both want control over the name.

i'm assuming josh would be annoyed about them trying to steal the name kyuss due to his "kyuss is the past theory" which i respect and well im sure we all agree it is indeed not kyuss without josh anyways

So, basically Homme (and Reeder) are suing as a reaction to Kyuss Lives! "name stealing" legal action.
I'd say the band should've just stick to the Kyuss Lives! name and move on... It's sad if in January they were all still on good terms. As Batdan wrote, money kills friendship. :/

^Yep, well at least this is how I understood it.
It's hard to say this hearing only one side of the story, but I don't get the band in this case. I really don't see why they need the original name back, except for money related reasons... And that sucks. :/

Kyuss Lives! members John Garcia and Brant Bjork have responded to the copyright infringement lawsuit that former Kyuss members Josh Homme and Scott Reeder dropped on their laps for touring as Kyuss Lives! earlier this year. The duo spoke about being blindsided by the suit; the meeting that took place between the parties beforehand; the fact that they never wanted to tour as Kyuss (sans the Lives!); the future of the band; the recent exit of bassist Nick Oliveri, saying he didn't like the inner workings of this project; and more. So much drama.

Garcia poignantly stated, "Win or lose, we believe that the name Kyuss Lives! is worth fighting for, and regardless of the outcome of this foolish lawsuit Josh Homme and Scott Reeder have filed against us, we will continue conducting business as usual and connecting with our amazing loyal fans. It is our God-given right to play any and every Kyuss song anywhere and anyhow we see fit, no matter who wrote what, and we will continue to do so for as long as we are alive. Because of this, we have already won."

Oh yeah, FWIW, Kyuss Lives! was one of the gnarliest rock shows I've ever seen, and I've seen a lot...

the energy from the band and crowd alike was freakin' amazeballs, coupled with the raddest muzak to ever blast through the Fowlers Live PA here in D'laide. In stark contrast, the recent Fu Manchu gig merely had glimpses of the fuzzed out fabulousness that once existed from that particular quartet. From the several QOTSA gigs I have seen, the Josh Homme I seem to remember most is the narcissistic, arrogant ranga cunt.
