FESTIVAL AWARDS - BEST FESTIVAL PHOTO
1. Entry into the Promotion
The Festival Awards Best Festival Photo Promotion (the Promotion) is operated by The Sound Alliance, located at Suite 5, 113, Reservoir St Surry Hills, Sydney NSW 2010. Entry into the Promotion is conditional upon You accepting these Terms & Conditions.
2. How to Enter
- You may supply a maximum of 2 low-res photos - 15cm wide at 72 DPI for entry into the Promotion
- The photos you submit must have been taken at a festival between September 7, 2008 and September 1, 2009 inclusive
- The photo must have been published by an official media entity either online or in print
- The Photo must be sent as a jpeg saved in the following format :

- Entries close on September 30, 2009
- Finalist entries will be hosted on a gallery online at http://www.fasterlouder.com.au/
- The Sound Alliance takes no responsibility or liability for entries not properly submitted or received for any reason
3. Submission Process & Requirements
With respect to any materials you submit in connection with this Promotion, you represent and warrant:
- You are the copyright owner; that you will not license or assign such copyright during the course of the Promotion, that you have full power and authority to grant the licenses and authorisations granted herein, and that submission of photographs will not be contrary to any law or any contract or agreement with any third-party
- The photographs contain lawful content only, including but not limited to being free of defamatory, infringing, obscene or other unlawful material in any way
Any breach of the foregoing representations and warranties will make the photographs subject to immediate removal from the Promotion and result in immediate disqualification of You from any further participation in the Promotion. Your access to the Sound Alliance web sites may be restricted, suspended or terminated at any time if we believe, in our sole discretion, that you have breached these Terms & Conditions or have engaged in any conduct detrimental to The Sound Alliance. Any such restriction, suspension or termination will be without prejudice to any rights that we may have against you in respect of your breach of these Terms & Conditions.
4. The Judging Process
Upon closure of the 2009 submissions period (23:59 hours on September 30, 2009), a shortlist of all entries will be reviewed by the judging panel, and a final vote will be held to determine the award recipient and any honorable mention recipients. The judges’ decision will be final and shall be made in their sole and absolute discretion. No correspondence will be entered into. Results will be announced at an event in Sydney on October 15, 2009 and will be announced online at www.fasterlouder.com.au from 9pm that same evening.
5. Use of Images
You grant The Sound Alliance an irrevocable, non-exclusive, worldwide royalty-free license to reproduce, publicly display, distribute, publicly perform and create derivative works from their photographs, in all media, solely in connection with the administration, judging and Promotion of the Promotion, including, but not limited to, on The Sound Alliance websites. Photographs will not be used for commercial advertising purposes and will not be altered without the prior consent of the author, except as necessary to display or distribute them in a particular medium or format at the event and online in the photo gallery at www.fasterlouder.com.au.
6. Participant Data
You grant The Sound Alliance the right to use submitted personal data (such as name, contact information, and email address) in the administration and judging of Promotion. We will use the email address you provide for communications related to the Promotion, including notification of the finalists and winners. Your personal data will not be provided to third parties for unsolicited marketing.
7. Intellectual Property
The content and design of www.fasterlouder.com.au and all related online activities including but not limited to www.fasterlouder.com.au/festivalawards/ is the property of The Sound Alliance. Nothing herein or related to the Promotion shall grant or imply any right by any person to use the trademarks or intellectual property of The Sound Alliance.
Subject to the licenses expressly granted herein, all intellectual property rights in the photographs you enter into the Promotion shall remain yours. In the event where one or more photographs submitted by you are selected to be displayed at the event or online at www.fasterlouder.com.au The Sound Alliance will include a reference to your name, provided, however, that any failure to include such a reference shall not be deemed to be a breach on the part of The Sound Alliance if you provide notification to festivalawards@staff.fasterlouder.com.au and the reference to your name is cured within a reasonable period, but no less than ten (10) days, from the date of receipt of notice of such failure.
